Özet
Bu yüksek lisans tezinde, temelde, verinin dijital ekonomideki yeri dikkate
alınarak, bir veri koruma hukuku ihlalinin aynı zamanda rekabet hukuku ihlaline yol
açmasının mümkün olup olmadığı konusu incelenmiştir. Bu doğrultuda, rekabet
hukukunun hedefleri, korumayı hedeflediği menfaat ile veri koruma hukukunun
korumayı amaçladığı menfaat karşılaştırılmış, ortak hedefleri ortaya konmuştur. Konu
Adalet Divanı ve Bundeskartelamt huzurunda görülen “Facebook v. Germany”
davasında tartışıldığından, dava özelinde ilgili değerlendirmeler yapılmış,
mahkemelerin kararlarına yer verilmiştir. Tezde, verinin dijital ekonomideki yeri ve
hukuka aykırı veri işleyen kişiyi rakipleri karşısında öne geçirmeye, hakim durumun
kötüye kullanılmasına yol açabileceği dikkate alındığında, hukuka aykırı veri
işlenmesinin aynı zamanda bir rekabet hukuku ihlali teşkil edebileceği sonucuna
ulaşılmıştır.
This master’s thesis primarily examines whether a violation of data protection
law can also lead to a violation of competition law, taking into account the role of data
in the digital economy. In this context, the objectives of competition law and the
interests it seeks to protect were compared with those of data protection law, and their
common objectives were identified. Since this issue was debated in the “Facebook v.
Germany” case before the Court of Justice of the European Union and the
Bundeskartellamt, the thesis provides case-specific analyses and cites the courts’
decisions. The thesis concludes that, given the role of data in the digital economy and
the fact that unlawful data processing could give an individual an unfair advantage
over competitors and lead to the abuse of a dominant position, unlawful data
processing may also constitute a violation of competition law.
