Heirs who are entitled to disclaim the inheritance may request the preparation of an official ledger of the estate. As a rule, where the inheritance is accepted according to the official ledger the estate passes to the heir together with the liabilities recorded therein. In order to ensure the registration of assets and liabilities in the ledger drawn up by the civil court, creditors and debtors are invited to declare their claims and obligations. Claims and debts ascertainable from official records are likewise entered into the ledger. Although the legal faith of debts not recorded in the official ledger due to the creditors fault is disputed, the prevailing view holds that such debts do not extinguish but are transformed into natural obligations. In contrast, where a debt is not recorded without any fault on the part of the creditor, an heir who has accepted the inheritance according to the ledger is liable only to the extent of his or her enrichment derived from the estate. In cases where a debt that ought to have been recorded ex officio is omitted, or where it is recorded incompletely or not at all despite notification by the creditor, the creditor may claim compensation for the resulting damage from the state. Furthermore, if the creditor was unable, for justified reasons, to have the claim entered into the official ledger, the heir who has accepted the inheritance according to the ledger is again liable only to the extent of enrichment. Finally, if the creditor’s claim is secured by a right in rem over estate assets, the creditor may satisfy the claim through enforcement proceedings by realization of the pledge, even if the claim has not been entered in the official ledger.
