Yargıtay Kararları Işığında Taşkın Yapıda İyiniyet Unsuru

Özet
Taşkın yapı, inşa edilen yapının sınırı aşarak komşu taşınmaza taşmasıdır. Taşkın yapının hukuki durumu Türk Medeni Kanunu md.725’te düzenlenmiştir. Hükmün ikinci fıkrasına göre, taşkın yapıyı yapanın iyi niyetli olması ve diğer koşulların da varlığı halinde, taşan kısım için irtifak hakkı kurulması ya da taşan kısmın mülkiyetinin taşkın yapıyı yapana devredilmesini taşkın yapıyı yapan talep edebilir. Bu sonucun gerçekleşebilmesi için Yargıtay kararlarına göre ilk önce tespit edilmesi gereken en önemli unsur, taşkın yapıyı yapanın iyiniyetli olmasıdır. Bu çalışmada taşkın yapıyı yapanın iyiniyetli kabul edilebilmesi için gereken unsurlar, Yargıtay kararları doğrultusunda açıklanacaktır. Taşkın yapıda iyiniyetin aranacağı kişi, iyiniyetin aranacağı an, durumun gerektirdiği dikkat ve özenin ölçütü ve iyiniyeti ispat yükü Yargıtay kararlarında sıklıkla rastlanılan durumlardır. Bunların her biri, Yargıtay’ın değerlendirmeleri, doktrindeki görüşlerle karşılaştırılarak ele alınacaktır. Yargıtay kararlarında kanunda yer alan düzenlemeyle bağdaşmayacak şekilde, çaplı taşınmazda iyiniyet iddiası dinlenmemektedir. Ayrıca yine kanun koyucunun amacına aykırı olacak şekilde taşkın yapıyı yapanın kendi iyiniyetini ispat etmesi gerektiği Yargıtay kararlarında kabul edilmektedir. Yargıtay’ın bu kararları doktrinde isabetli olarak eleştirilmektedir. Çalışmada bu yönde açıklamalara yer verilmiştir.
Encroaching Construction refers to a situation in which a structure is built in such a way that it extends beyond the boundary line and intrudes upon an adjacent immovable property. The legal status of encroaching constructions is regulated under Article 725 of the Turkish Civil Code. According to the second paragraph of this provision, if the person who has constructed the encroaching structure acted in good faith and other legal conditions are also met, that person may request the establishment of an easement right over the encroached portion or the transfer of ownership of the encroached land to themselves. In order for this legal consequence to arise, the primary element that must first be established-according to the decisions of the Court of Cassation is the good faith of the builder of the encroaching structure. This study will explain, in light of Yargıtay jurisprudence, the requirements for considering the builder to be in good faith. Issues frequently encountered in the case law of Yargıtay include: the person whose good faith is to be assessed, the point in time at which good faith is to be evaluated, the standard of due care and diligence required by the circumstances, and the burden of proof regarding good faith. In particular, the assessments of the Court of Cassation will be discussed in comparison with the doctrinal opinions expressed in the legal scholarship. In the case law of the Court of Cassation, a plea of good faith is not entertained in respect of registered immovable property in a manner that is incompatible with the statutory regulation. Moreover, contrary to the legislative intent, the Court of Cassation holds that the party who has constructed the encroaching structure must prove his own good faith. These decisions of the Court of Cassation have been rightly criticized in the legal doctrine. This study includes explanations in this regard.
